LuxSignals — Terms of Service

These Terms of Service ("Terms") govern your access to and use of the LuxSignals products and services, including indicators, tools, websites, customer portals, documentation, communications, and any related software or content (collectively, the "Services"). By creating an account, starting a free trial, purchasing a subscription, or otherwise using the Services, you ("you" or the "Customer") agree to be bound by these Terms.

If you do not agree, do not use the Services.

LuxSignals ("LuxSignals", "we", "us", "our") provides the Services. Contact: info@luxsignals.com.

1) Definitions

  • Account: Your user profile and credentials used to access the Services.
  • Subscription: A recurring paid plan that grants ongoing access to the Services.
  • Free Trial: A time-limited, no-cost access period for new customers as described in Section 6.
  • Customer Portal: The authenticated page that allows you to manage your subscription, payment methods, and cancellation.
  • Third-Party Platforms: External services required to use parts of the Services (e.g., TradingView).
  • Payment Processor: Our contracted provider(s) that process card and other payments on our behalf.

2) Eligibility, Accounts, and Security

1. Eligibility. You must be able to form a legally binding contract in your place of residence. If you are under the age of majority, you may use the Services only with the consent and supervision of a parent or legal guardian who agrees to these Terms.

2. Registration Information. You must provide accurate, current, and complete information and keep it updated.

3. Account Security. You are responsible for safeguarding your credentials and for all activities under your Account. Notify us immediately of any unauthorised use.

4. Identity Verification. To protect customers and reduce fraud, we may require identity verification (e.g., government ID checks) before granting or continuing access, before issuing refunds, or when risk signals are detected.

3) Description of Services; Educational Use Only

LuxSignals provides analytical tools and indicators for research and educational purposes. We do not provide investment, financial, legal, tax, or accounting advice, and we are not your fiduciary or investment adviser. Trading involves risk, including the loss of all invested capital. Past performance is not indicative of future results. You make all trading decisions independently.

4) Third-Party Platforms and Tools

Some features require Third-Party Platforms (for example, TradingView). You are solely responsible for creating, maintaining, and paying for those third-party accounts. We do not control third-party services and are not responsible for their availability, accuracy, policies, or performance.

TradingView® is a registered trademark of TradingView, Inc. TradingView has no affiliation with LuxSignals and does not endorse our products.

5) Pricing, Taxes, and Statement Descriptor

1. Pricing is shown at checkout and in your order confirmation. If we offer promotional or crossed-out prices, the actual charge is the clearly shown, non-crossed price above each tier and billing cycle.

2. Taxes. Prices may be exclusive of VAT/GST/sales or similar taxes unless otherwise stated. You are responsible for applicable taxes where required by law.

3. Statement Descriptor. Your card statement will reference our business name and/or a descriptor disclosed at checkout and in your email receipt. Every receipt and invoice will include a manage/cancel link to your Customer Portal.

6) Free Trial and Automatic Renewal (Clear Consent)

1. Trial Length. New customers may receive a 7-day free trial beginning when access is first granted.

2. Pre-Renewal Reminders. To prevent recognition/renewal misunderstandings, we send T-72-hour and T-24-hour reminders before the trial converts to a paid Subscription. We also send a brief check-in on day 3 of the trial.

3. Conversion to Paid. If you do not cancel before trial expiry, the trial automatically converts into the selected paid Subscription and your saved payment method is charged for the first billing period.

4. Explicit Consent. Checkout includes a mandatory checkbox next to plain-language text (for example): "I understand my trial renews on [DATE] to [PLAN & PRICE] unless I cancel beforehand." We log your consent (timestamp, IP, email) and store it securely.

5. Access After Cancellation. If you cancel during the trial or later, you retain access until the end of the current paid period to avoid ambiguity about value received.

7) Authentication and Risk Controls (Payments)

To reduce failed payments and fraud:

  • We require CVC/AVS where supported and default to 3D Secure step-up when available.
  • We may perform pre-authorisations or micro-authorisations to verify cards.
  • We limit smart-retry attempts and will prompt you to update your card via secure portal links rather than repeatedly retrying.
  • If payment cannot be completed after limited attempts, we will cancel the Subscription to avoid "limbo" states (we do not use "pause payment collection" as a pseudo-cancellation).

8) Managing Your Subscription (Customer Portal)

You can view invoices, update payment methods, and cancel anytime via the Customer Portal link shown:

  • on checkout confirmation pages,
  • in your account area, and
  • in every receipt and renewal email.

Support (info@luxsignals.com) is available for guidance, but cancellations must be completed by you in the Customer Portal for security and auditability.

9) Cancellations and Refunds

To minimise disputes and ensure fair outcomes, we offer a 30-day refund window for each charge as follows:

1. No-Questions-Asked Window. You may request a full refund for any charge within 30 days of its charge date. This applies to initial purchases, renewals, and upgrades.

2. How to Request. Email info@luxsignals.com from the purchaser email or use the Customer Portal's refund request option (where available). Include the invoice number or the charge date and amount.

3. Processing Time. Approved refunds are issued to the original payment method. Banks typically settle funds within 5–10 business days.

4. Access After Refund. When a refund is granted, access tied to the refunded charge may be revoked immediately or at period end, at our discretion.

5. Good-Faith Use; Abuse. We may refuse or limit refunds if we reasonably detect fraud, identity mismatch, or clear abuse (e.g., repeated refund-and-retain-access attempts across multiple accounts).

6. Statutory Rights. If mandatory consumer laws where you live provide additional rights (e.g., withdrawal rights), we honour those rights in addition to this policy.

We encourage you to contact us first. If you are unhappy or confused, we will resolve it quickly—most commonly with a prompt refund within this 30-day window—so that a chargeback is unnecessary.

10) Disputes and Chargebacks (Resolution First)

1. Our Commitment. We aim to resolve concerns on first contact. If a mistake or misunderstanding occurs, we will offer a full refund under Section 9 rather than allow escalation.

2. Evidence for Fraud. If a third party used your card without permission, tell us immediately. We will close access and provide payment processors with delivery and access logs.

3. Our Ask. Please use the 30-day refund route with us before initiating a chargeback. It is faster for you and prevents account interruptions.

4. Our Response. We respond to 100% of disputes with clear evidence (order logs, platform username access, timestamps, IP/email). For recognition issues, we typically recommend a merchant-initiated refund instead of contesting. For confirmed stolen-card fraud, we cooperate fully with issuers.

11) Service Levels and Support

  • Billing/Access Support SLA: We target responses within 12 hours, and within 4 hours during trial or renewal windows.
  • Channels: Email info@luxsignals.com. We may provide additional channels (e.g., chat) from time to time.

12) Testing Discipline (No Live-Mode Tests)

We perform all product and payment tests in test mode only. If you suspect a test action affected you in live mode, contact us and we will reverse it immediately.

13) Acceptable Use

You agree not to:

  • share, resell, or sublicense the Services without written permission;
  • circumvent authentication, rate limits, or access controls;
  • reverse engineer or copy source code or proprietary models;
  • use the Services to violate laws or third-party rights;
  • upload malicious code or try to disrupt the Services;
  • create multiple accounts to exploit promotions or refunds.

We may suspend or terminate access for violations. Where appropriate, we will provide advance notice and an opportunity to cure.

14) Intellectual Property

All content, software, designs, trade names, trademarks, and documentation in the Services are owned by LuxSignals or our licensors and are protected by applicable IP laws. We grant you a non-exclusive, revocable, non-transferable licence to use the Services for your own research and educational purposes during your active Subscription.

15) Educational and Performance Disclaimers

  • No Advice. The Services are educational. We do not make personalised recommendations.
  • No Guarantees. We do not guarantee results or profits. Hypothetical/simulated results have limitations and do not reflect real trading conditions.
  • Your Responsibility. You are solely responsible for trading decisions and outcomes.

16) Data, Privacy, and Security

We log consent and access events (e.g., timestamps, IPs, usernames) to provide support, reduce disputes, and improve safety. Our processing of personal data is governed by our Privacy Policy. We implement appropriate technical and organisational measures, including step-up authentication, 3D Secure, and evidence preservation for fraud prevention.

17) Failed Payments, Retries, and Non-Payment

  • We keep retry attempts minimal to reduce noise.
  • We will prompt you to update your card rather than retrying continuously.
  • If payment is unresolved after limited attempts, we cancel the Subscription (no "paused collection" limbo).
  • You can re-subscribe anytime.

18) Affiliate Programme (Clawbacks)

If a transaction is refunded or charged back, any associated commission is reversed. If commissions were already paid out, the affiliate must return the affected amount within a reasonable period after notice. We may net such amounts against future payouts.

19) Warranties; Limitation of Liability

The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied (including merchantability and fitness for a particular purpose). To the extent permitted by law, our total liability for any claim arising out of or relating to these Terms or the Services will not exceed the amounts you paid to us in the 12 months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

20) Indemnity

You agree to indemnify and hold harmless LuxSignals and its officers, directors, employees, and agents from and against claims, damages, losses, and expenses (including reasonable legal fees) arising from your unlawful use of the Services or violation of these Terms.

21) Changes to the Services and to These Terms

We may update the Services and these Terms to improve clarity, security, and compliance. Material changes will be communicated by email or prominent notice at least 14 days in advance, unless a faster change is required by law or security. Continued use after the effective date constitutes acceptance.

22) Suspension and Termination

We may suspend or terminate access for material breaches (e.g., fraud, abuse, unlawful use), following notice where reasonable. You may cancel at any time in the Customer Portal. Refund rights under Section 9 remain available for any qualifying charge.

23) Miscellaneous

  • Entire Agreement. These Terms, together with any plan-specific terms, order pages, and the Privacy Policy, are the entire agreement between you and us regarding the Services.
  • Severability. If any provision is found unenforceable, it will be modified to the minimum extent necessary, and the remainder will remain in effect.
  • No Waiver. Failure to enforce a provision is not a waiver.
  • Assignment. You may not assign your rights without our consent. We may assign to an affiliate or in connection with a merger or sale.
